Terms of Service

1. The user shall be responsible for maintaining the confidentiality of his or her password, which he or she will not be under any obligation to reveal to any representative or agent of MaltaComics.com. The user is therefore responsible for all transactions under their account name and password.

2. MaltaComics.com have the right to terminate an account and/or cancel any orders at our discretion and at no charge to the customer. In the case of an order being cancelled, the client will be given a full refund for the value of that purchase.

3. MaltaComics.com contains material which is owned or licensed to MaltaComics & Collectibles. This material includes, but is not limited to the design, layout, look, appearance, graphics and product images. Reproduction of any of the above is prohibited other than in accordance with the copyright notice which forms part of these terms and conditions.

4. Content of the site – Prices and details of products on this website are subject to change without notice. All products are subject to availability and we can give no guarantee in this regard. Procedures are in place to minimize these discrepancies however, due to circumstances beyond our control, some discrepancies may arise.

5. MaltaComics.com accepts the offer of purchase when an email confirmation is sent to the customer. If multiple items occur on a single transaction and an email confirmation is sent covering a portion of the items on the transaction, then only the items covered on the confirmation email are covered by this contract of sale. Should any transaction be cancelled, the customer will have the right to a full refund.

6. Prices quoted on this website are for online sales only and may differ from retail prices at MaltaComics Outlets.

7. In accordance with Regulation 10 of the Consumer Rights Regulations, all goods purchased from MaltaComics.com have a right of withdrawal period of 14 days. Any goods returned during this period must be returned in the same condition as supplied. MaltaComics.com reserves the right to refuse any damaged and/or open goods at its own discretion. Please note that this right of withdrawal does not apply to the sale of periodicals, newspapers or magazines.

8. The right of withdrawal can be exercised by sending an email to admin@maltacomics.com; or where you have already received the goods by returning the goods to any MaltaComics outlet with the original invoice; or by filling in the Goods Return Form and sending this by post, if provided. Products should be returned to any MaltaComics outlet within 14 days from communicating your decision to exercise your right of withdrawal at the client’s expense. Refunds are not automatic, they are generally processed by the following Monday a request has been made.

9. Due to the large number of items posted on the website, it is possible that some products may no longer be available at time of order. Whilst MaltaComics.com attempts to minimize this as far as possible, such situations can arise. Such incidents will result in a full refund for the customer by not later than 30 days from purchase date. The customer will be informed about the status of their order as soon as such information becomes available.

10. Dispatch and delivery times are estimates and whilst we try our best to meet these, situations beyond our control may arise. The customer has the right to terminate an order of goods which are not received within 30 days of purchase date unless: (a) the item is being sold as a preorder, in which case an estimated timeframe will be provided when the manufacturer intends to release and distribute said item; (b) the item has already shipped, is in transit and/or held at Customs waiting for clearance. MaltaComics.com reserve the right to impose additional delays to delivery times & estimates in the event of a pandemic, lockdown, disaster, war or other event within or outside the territories of the Maltese Islands which prevent the delivery of said order. In the event of this occurring, clients will be duly notified and updated. Hence, if a Government lockdown is imposed for 60 days, such time will be added to the additional delivery time and estimate at the client’s expense.

11. In the event an order is eligible for free delivery due to reaching a certain fixed amount, and later the client opts to cancel part of the order rendering it less than is required for free delivery, then the client must bear the expense of a regular delivery of his choice or pick up items from store.

12. Items purchased through the website and in stock must be picked up within 5 working days unless a delivery option has been chosen during the purchase process. Clients will be duly notified via email and through the website’s Order Update Section which clients can access through their account. After this timeframe orders will be cancelled and no refund will be given. The same applies to orders where part of the items are already in stock & other items are on back or preorder. In this case, items in stock must be picked up within 5 working days unless a written agreement is reached between MaltaComics.com and the client in the event other items are expected to arrive within an additional 5 working days. This will be reached so as to keep disruption to both the client’s and MaltaComics’ schedule to a minimum.

13. All prices displayed on the website are inclusive of applicable Malta VAT rates on printed matter, currently 5%, otherwise 18% on other items.

14. MaltaComics.com reserves the right to impose additional charges and/or provide partial refunds in the event a client tries to bypass or change, whether intentional or not, certain conditions imposed by the website or by law resulting in damages or further expenses to MaltaComics.com. Such situations include but are not limited to change of addresses resulting in higher shipping fees, providing false/wrong information at time of checkout, requesting additional services not included at time of checkout, or a delivery attempt where the client is not at his/her address at time of delivery, so that MaltaComics.com must attempt a second delivery. Cancellations of preorders may also result in a penalty resulting in a loss of a partial or full refund.

15. Your use of the website and any dispute arising out of such use is subject to the Laws of Malta. Any disputes that may occur must be executed physically in the Maltese Territories via the competent authorities handling consumer laws & other disputes.

16. In accordance with the Data Protection Act and in order to safeguard the interest of our customers, Malta-comics.com does not store or have access to view any sensitive customer data, such as Credit Card Number, other credit card information and your personal Malta-comics.com Password. No member of staff from MaltaComics.com will ever ask you for your website password.

17. To the fullest extent permitted by law, MaltaComics.com is providing this site and its contents on an ‘as is’ basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, MaltaComics.com does not represent or warrant that the information accessible via this site is accurate, complete or current.

18. If any provision of these Terms & Conditions shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

19. Any contract resulting from the purchase of a product from maltacomics.com will be executed & concluded in the English language.
